A landlord may terminate a lease of residential or commercial space on the grounds of urgent use by the landlord itself.

Urgent use by the landlord itself means that the landlord urgently requires the leased dwelling or retail space for its own use, as a result of which the lease cannot be extended. This may apply in the event of renovation or demolition of residential or commercial space that is impossible without terminating the lease, or if the landlord itself wishes to use the space. Sufficient facts and circumstances must then be presented to demonstrate such urgent use by the landlord. The landlord’s interest must then outweigh the tenant’s interest, and also be in the tenant’s own interest, and a suitable alternative must be available for the tenant.
